生产销售假药罪所涉的法益重思——试析该罪所涉之集合法益

摘　　要：《刑法修正案(八)》删除了生产、销售假药罪中“足以严重危害人体健康”的规范要素,进一步表明该罪对所涉秩序法益的保护倾向,鉴此有必要重新解读该罪所涉的法益保护。以人本法益观为基础的“个人法益说”和以集体法益观为基础的“秩序法益说”皆因其偏激的观点而致支持者甚少,而折中的“复合法益说”乃成为通说,但其却依旧存在理论缺漏:没有回答药品管理秩序和生命健康权之间是“相加关系”还是“相融关系”,也没有揭示秩序法益作为派生性法益的外层考核机能和个人法益作为原生性法益的内核检验机能;故须在复合法益的基础上提出生产、销售假药罪所涉的法益保护是集合法益,应将药品管理秩序和生命健康权表述为“事关生命健康的药品管理秩序”。The Amendment to the Criminal Law(VIII)deleted the normative elements of"enough to harm human health"in the crime of producing and selling counterfeit drugs,which further expresses the tendency to protect the legal interests of order.In view of this,it is necessary to reinterpret the legal interest protection involved in this crime.The"theory of individual legal interest"based on the view of human legal interest and the"theory of order legal interest"based on the view of collective legal interest both have very few supporters because of their extreme views.The compromise theory of"complex legal interests"has become a general theory,but it still has theoretical deficiencies as follows:It does not answer whether there is"additive relationship"or"integration relationship"between drug administration order and life and right to health,nor does it reveal the outer examination function of order legal interest as generative legal interest and the inner examination function of individual legal interest as generative legal interest.Therefore,on the basis of compounding legal interests,it should be proposed that the legal interests involved in the crime of producing and selling counterfeit drugs are the collection of legal interests,and the drug administration order and the right to life and health should be expressed as"the drug administration order concerning life and health".
