警务辅助人员参与公安行政执法的权限及其边界问题探讨

摘　　要：长期以来,对于警务辅助人员参与公安行政执法的权限都存在不同的认识,正是源于这些不同认识,警务辅助人员参与公安行政执法还存在相关管理体制不齐、法律身份定位不明、“权力”属性不清、权限范围规范不健全等突出问题。有必要在辨析警务辅助人员概念的基础上,深入分析警务辅助人员参与公安行政执法的“权力”属性。借鉴域外相关制度,以具有代表性的《深圳经济特区警务辅助人员条例》为切入点,基于警务活动所涉公共性的强弱,具体划分弱公共性、相对或半公共性、绝对或纯公共性警察行政领域,科学厘定我国警务辅助人员参与公安行政执法的权力边界。For a long time, there have been different understandings about the rights of police auxiliary personnel to participate in public security administrative law enforcement. It is precisely because of these different understandings that there are still some obvious problems in police auxiliary personnel’s participation in public security administrative law enforcement, such as uneven management system, unclear legal status, unclear attribute of "power", and imperfect scope of authority. It is necessary to analyze the "power" attribute of police auxiliary personnel’s participation in public security administrative law enforcement on the basis of distinguishing the concept of police auxiliary personnel. Based on the representative Regulations of Shenzhen Special Economic Zone on Police Auxiliary Personnel and the strength of the publicity involved in police activities, this paper draws lessons from foreign related systems, specifically divides the police administrative fields of weak publicity, relative or semi-publicity, absolute or pure publicity, and scientifically determines the power boundary of police auxiliary personnel’s participation in public security administrative law enforcement in China.
