论健全保证宪法全面实施的制度体系

摘　　要：健全保证宪法全面实施的制度体系,是党的二十大提出的战略任务,是全面实施宪法的总抓手,反映了党的自我革命的客观要求。推进制度体系建设,不仅要完善保证国家机关实施宪法制度,更重要的是要完善保证党实施宪法制度。党的十八大以来,保证宪法全面实施制度建设取得了突破性进展,但仍存在缺乏统筹谋划、基础主干制度不完善、配套制度不完备等突出问题。建议加强顶层设计,制定宪法解释法、合宪性审查法、宪法修改法、备案审查法,完善依宪立法、司法机关实施宪法制度,健全保证党实施宪法制度,以科学有效、系统完备的制度体系保证宪法实施。Improving the institutional system to ensure the full implementation of the Constitution is a strategic task proposed at the 20th National Congress of the Communist Party of China(CPC).It is the general catcher of the full implementation of the Constitution,and reflects the objective requirements of the Party’s self revolution.To promote the construction of the system,we should not only improve the system to ensure the implementation of the Constitution by state organs,but also more importantly,improve the system to ensure the implementation of the Constitution by the Party.Since the 18th National Congress of the Communist Party of China(CPC),breakthroughs have been made in ensuring the full implementation of the Constitution.However,there are still outstanding problems such as lack of overall planning,incomplete basic backbone systems,and incomplete supporting systems.It is suggested to strengthen the top-level design,formulate the constitution interpretation law,the constitutional review law,the constitution amendment law,and the record review law,improve the system for legislating in accordance with the Constitution and for judicial organs to apply the Constitution,improve the system to ensure the implementation of the Constitution by the Party,and ensure the implementation of the Constitution with a scientific,effective,systematic and complete system.
