摘  要:在数字信息时代,区块链、元宇宙、NFT数字作品等新兴科技、经济概念对既有著作权法律概念与制度形成冲击。从著作权法语境下“作品”及相关概念之嬗变出发,分析分别对应不同时代传统作品、数字作品、NFT数字作品的特点以及同作品类型在传播过程中的法律性质之殊异,建立适用于数字网络环境下以作品类型为分野的发行权与权利穷竭原则的灵活适用机制,厘清新技术、新业态、新领域冲击下发行权与信息网络传播权的边界,有利于调和数字网络环境下的作者、传播者与用户之间的权利与义务关系,助力我国文化、艺术与科学事业的发展与繁荣。In the digital information age,new technological and economic concepts such as blockchain,metaverse and NFT digital works have had an impact on the existing legal concepts and systems of copyright.Starting from the transmutation of“work”and related concepts in the context of copyright law,the paper analyzes the characteristics of traditional works,digital works and NFT digital works in different eras and the differences in the legal nature of the same work type in the process of dissemination,and establish the flexible application mechanism of the right of distribution and the principle of exhaustion of rights applicable to the digital network environment with the distinction of work types.This will clarify the boundary between the right of distribution and the right of information network dissemination under the impact of new technologies,new industries and new fields,and help to reconcile the rights and obligations of authors,distributors and users in the digital network environment and contribute to the development and prosperity of culture,art and science in China.
