摘 要:对自动驾驶行为进行罪刑评价,需要区别对待完全自动驾驶行为和辅助驾驶行为。与对完全的自动驾驶行为的刑事责任追究不同,对辅助驾驶行为进行刑事归责应遵循独特的逻辑。由于辅助驾驶行为本质上仍然是驾驶人员的行为,对辅助驾驶行为的犯罪化就是对驾驶人员的行为进行犯罪化,因而要排除汽车设计者、生产者、销售者构成犯罪的可能。驾驶人员基于辅助驾驶行为不但可以构成交通肇事罪,也可以构成以危险方法危害公共安全罪、故意杀人罪等。驾驶人员虽然可以依据技术规则和法律规定进行刑罚上的抗辩,但不能排除其自身行为的刑事可归责性。When it is necessary to evaluate the crime and punishment of automatic driving behavior,it is still necessary to distinguish between fully automatic driving behavior and assisted automatic driving behavior.Different from the criminal liability investigation of full automatic driving,the criminal liability of auxiliary driving behavior should follow a unique logic.Since the auxiliary driving behavior is essentially the behavior of the driver,the criminalization of the auxiliary driving behavior is the criminalization of the driver’s behavior.Therefore,it is necessary to exclude the possibility that the automobile designer and manufacturer constitute a crime.The behavior of drivers can not only constitute the crime of causing traffic accidents,but also constitute the crime of endangering public safety by dangerous means and the crime of intentional homicide.Although the driver can plead on the penalty according to the technical rules and the provisions of the legal system,he can not claim the innocence of his own behavior.
