深化基层立法联系点建设:理论预设、现实问题与应对路径

摘　　要：党的二十大站在实现中国式现代化的战略全局高度,把建设好基层立法联系点作为“发展全过程人民民主,保障人民当家作主”的重要内容进行部署,赋予了基层立法联系点新的历史使命与任务。全过程人民民主是事关我国民主政治建设的宏大命题,其中,以人民为中心是全过程人民民主的价值依归,民主协商、民主监督始终贯穿民主活动全过程,是全过程人民民主的逻辑意蕴,真实有效是全过程人民民主的实践效能,三者共同构成了基层立法联系点制度发展完善的理论指引。通过基层立法联系点实际运行状况与理论预设的比较,当前影响基层立法联系点深化发展的问题可以体系性归纳为参与主体广泛性的问题、运行机制稳定性持续性的问题、功能拓展的问题、制度真实有效性的问题。由此,深化基层立法联系点建设要持续扩大联系点参与主体范围,进一步增强联系点运行机制的稳定性持续性,切实提升公众参与的体验感和实效性。Standing at the height of realizing Chinese path to modernization, the 20th National Congress of the Communist Party of China put the construction of local legislative outreach offices(LLOO) as an important part for‘developing whole-process people’s democracy and ensuring that people are masters of the country.’assigning LLOO new historical mission and task. The whole-process people’s democracy is a grand project concerning China’s construction of democratic politics, of which putting people at the center is the orientation of its value;democratic consultation and democratic supervision are its logical implication;authenticity and effectiveness are its practical effectiveness, and all these serve as theoretical guide for developing and improving LLOOThrough comparison between the actual operation and the theoretical presupposition of LLOO, problems currently affecting LLOO’s further development can be systematically summarized as issues of wide participation, stability and sustainability of the operation mechanism, expansion of functions,and authenticity and effectiveness of the system.Accordingly, this paper proposes that to deepen the construction of LLOO, the scope of participants should be expanded, the stability and sustainability of LLOO’s outreach offices’ operation mechanism should be strengthened, and the experience and effectiveness of public participation should be improved.
