法理学视域下公安执法中的私权保护

摘　　要：公安执法是公权力的体现,具有强制性特征,公安执法又常常涉及公民私权,这使得两者在一定程度上不可避免地出现冲突。由于传统法律文化的影响、社会私权意识的缺失、现行公安管理体制的制约、执法中私权保护的法律依据不完备、不重视公安执法的程序性、个别民警的执法能力不足等原因,公安执法领域还存在一些侵害私权的现象。应完善立法,健全管理体制,明确公安执法权运行规则,提高民警的执法素质并加强对公安执法过程的监督,以实现公安执法过程中的私权保护。Public security law enforcement is the embodiment of public power,with mandatory characteristics,and public security law enforcement often involves the private rights of citizens,which makes the two inevitably appear conflicts to a certain extent.Due to the influence of traditional legal culture,the lack of social awareness of private rights,the restriction of the current public security management system,the incomplete legal basis for the protection of private rights in law enforcement,the lack of attention to the procedural nature of public security law enforcement,and the lack of law enforcement ability of individual police officers,there are still some violations of private rights in the field of public security law enforcement.It is necessary to perfect the legislation,perfect the management system,clarify the operation rules of the police’s law enforcement power,improve the police’s law enforcement quality and strengthen the supervision of the public security law enforcement process so as to realize the protection of private rights in the process of public security law enforcement.
