摘　　要：行政机关对轻微违法经营行为进行处罚,需要处理好行政处罚法与特别法、法定要件和自由裁量、市场主体权益与社会公共利益、教育与处罚等之间的关系。通过对轻微违法经营行为的司法审查,能够明晰针对轻微违法经营行为提起诉讼的原告资格、不予行政处罚的构成要件以及法院对行政处罚自由裁量权的审查内容、强度等问题,既能有效监督依法行政,规范行政自由裁量权,也能通过个案裁判规则的创制,为法定条文的原则性以及免罚清单的有限性提供有益之补充。In order to punish minor illegal business behaviors,administrative organs should deal with the relationship between administrative punishment law and special law,legal requirements and discretion,rights and interests of market subjects and social public interests,education and punishment,etc.Through the judicial review of minor illegal business behavior,clear lawsuit against minor illegal conduct of components of the plaintiff qualification,no administrative punishment and the court review of administrative penalty discretion problems,such as the content,the strength can effectively supervise the administration according to law,standardize the administrative discretion,also can through the case the referee rules to create,It provides a useful supplement for the principle of statutory provisions and the limitation of the list of exemption from punishment.
