摘　　要：党的二十大报告中指出,要实施积极应对人口老龄化国家战略,突出强调了对于老年人的人权关怀。数字人权架构于智慧社会建设的基础之上,是科技与法律共生演化、相互缠绕的人权形态重塑。数字科技开发利用中“老年数字弱势群体”的出现,体现了数字人权逻辑下智慧社会治理困境的特殊主体缘由,也反映出各个数字利益主体相互之间共生式的权利博弈关系,深入揭示智慧社会变革引发的老年数字弱势群体权利的实质不平等问题,分析数字鸿沟诱发老年群体社会关系边缘化的风险,将有助于避免社会数字化进程中仅仅是将人作为信息处理的客体,造成“数字麻木”。从伦理性、道义性、正当性反思数字人权嵌入维度,实现从数字治理向权利保护、从不平等技术供给关系向数字权利正义、从倡导性解决策略向强制性法律保护的升级转型。对此,需分析数字技术使用中不正义行为的客观存在,植入倾斜保护原则,对老年数字弱势群体的权利义务予以矫正,前移法律介入保护,确立防止侵害义务,推进老年数字弱势群体权利保护的平权变革,凸显出数字化时代的“科技温度”。The report on the Party’s 20th National Congress pointed out that the national strategy of actively dealing with the aging population should be implemented,highlighting the concern for the human rights of the elderly.Based on the construction of a smart society,digital human rights is a reshaping of human rights form in which technology and law coexist and intertwine.The emergence of“elderly digital vulnerable groups”in the development and utilization of digital technology reflects the special subject cause of the governance dilemma of smart society under the logic of digital human rights,reflects the symbiotic rights game relationship among various digital interest subjects,revealing the substantial inequality of the rights of the elderly digital vulnerable groups caused by the reform of smart society.The analysis of the risk of the marginalization of the social relations of the elderly group caused by the digital divide will help to avoid the“digital numbness”caused by the process of social digitalization which only takes people as the object of information processing.Reflecting on the embedding dimension of digital human rights from the perspective of ethics,morality and legitimacy helps to realize the upgrading transformation from digital governance to rights protection,from unequal technology supply relationship to digital rights justice,and from advocacy solution strategy to mandatory legal protection.In this regard,it is necessary to analyze the objective existence of unjust behaviors in the use of digital technology,implant the principle of slanted protection,correct the rights and obligations of the elderly digital vulnerable groups,advance the legal intervention in protection,establish the obligation to prevent infringement,and promote the reform of affirmative action in the protection of the rights of the elderly digital vulnerable groups,highlighting the“temperature of science and technology”in the digital age.
