摘 要:养老服务法治化建设的首要问题是界定养老服务的范围和法律性质。养老服务源自养老照料义务承担者与实际照料提供者的分离,我国养老服务的发展经历了老年福利服务—社会养老服务—养老服务的演进历程。养老服务不再是老年社会福利,而是属于社会服务。养老服务属于养老照料服务,而非老龄服务。养老服务是养老服务机构基于委托所提供的生活照料,其是养老照料义务的一种实现方式。养老照料义务应实行多元主体共担机制,家庭、社会和国家都要承担相应的养老照料义务。The primary problem in the construction of the legalization of elderly care service is to define the scope and the nature of elderly care service. The elderly care service originated from the separation of the obligator of the elderly care and the actual service provider. The elderly care service in China has gone through the evolution from elderly welfare service to social elderly care service to elderly care service. Elderly care service is no longer the social welfare of the elderly, but social service. Elderly care service is care service for the elderly, not old-age ser-vice. Elderly care service is a life care service provided by the elderly care institutions based on commission, which is a way of realizing the obligation of elderly care. The obligation of elderly care shall implement a multi-subject and co-sharing mechanism;Family, society and the state must assume the corresponding elderly care obligation.
