摘　　要：在关于可持续性竞争的十项议题指引下,德国《反限制竞争法》第十一次修订部长级草案正式发布。该法律草案聚焦于强化德国反垄断法律制度的执行,是德国采取更为积极的竞争政策的体现。在内容构建层面,这项法律草案促成传统反垄断规制范式的重大转型,简化对由垄断行为所衍生经济利益的征纳程序,并构筑起德国《反限制竞争法》与欧盟《数字市场法》交融适用的机制。尽管该法律草案为德国反垄断监管的现代化改革提供前瞻性规划,但是对反垄断规制范式的转换可能会反噬反垄断法律制度的稳定性,因此德国修法机关有必要修正与优化这项法律草案的细化规定,并谨慎推进反垄断规制范式的革新进程。Guided by the ten themes of sustainable competition,the Ministerial Draft on the 11th revision of the German Act against Restraints of Competition was officially launched.This Draft focuses on strengthening the implementation of German anti-monopoly legal system,which is a manifestation of a more proactive competition policy adopted by Germany.In terms of content construction,this Draft contributes to a major transformation of the traditional anti-monopoly regulation paradigm,simplifies the collection process for economic benefits derived from monopolistic behavior,and builds a mechanism for the integration and application of the German Act against Restraints of Competition and the EU Digital Market Law.Although this Draft provides forward-looking planning for the modernization of anti-monopoly regulation in Germany,its transformation in relation to the anti-monopoly regulation paradigm may devour the stability of the anti-monopoly legal system,so it is necessary for the German legislative bodies to amend and optimize the detailed provisions of this Draft and carefully advance the innovation process of the anti-monopoly regulation paradigm.
