局部外观设计专利侵权判定规则研究

摘　　要：我国《专利法》第四次修正引入了局部外观设计专利制度,其侵权判定规则成为学界和实务界亟须回应的重大理论和实践问题。针对当前我国外观设计侵权判定规则在保护局部设计创新上的不足,梳理司法裁判思路,借鉴域外较为成熟的经验,提出在个案适用中具体分析“一般消费者”所对应的主体范畴,适应性的调整和提高判断主体的认知水平,确定侵权判断主体;以表示在图片设计为准,相同或者相近的产品类别为原则,有限认可局部外观设计的独立价值,厘清权利保护范围;以“整体观察+综合判断”为基础,吸收创新标准有益内核的修正“整体观察+综合判断”,明确侵权判断方法,从整体上修正现有的侵权判定规则以接纳局部外观设计。The fourth amendment of the Patent Law of China introduced the system of partial design patent,and its infringement judgment rules have become important theoretical and practical issues that the academic and practical circles need to respond urgently.In view of the deficiencies that are not conducive to the protection of partial innovation in the current judging rules of design infringement in China,this paper combs the ideas of judicial adjudication,draws on more mature experience abroad,and proposes to specifically analyze the subject category corresponding to“general consumers”in case application,adjusts adaptability and improves the cognitive level of the judging subject,and clarifies the judging subject of infringement.In accordance with the principle of representing the same or similar product categories in picture design,the independent value of partial appearance design is limited to be recognized and the scope of rights protection is clarified.On the basis of“overall observation&comprehensive judgment”,the“overall observation&comprehensive judgment”is modified by absorbing the beneficial core of innovation standards,defining the method of infringement judgment and modifying the existing infringement judgment rules as a whole to accept partial designs.
