摘　　要：新冠病毒暴发的同时亦带来了一系列棘手的难题,疫情防控下对于密切接触者或感染者的宠物处理问题为其之一。防疫人员尚未经过上级有关防疫部门批准缺乏规范性文件支撑的乱扑滥杀宠物属行政行为违法,即使有关部门制定相应规范性文件没有上位法支撑或违法上位法时亦不能阻却违法之嫌,属规范性文件违法。宠物在法律关系中的地位只能属大客体范畴,但这种客体迥异于一般客体而受到特殊的保护。虽然乱扑滥杀宠物行为现阶段并不能动用刑事法规范予以制裁,但这种违法行为仍应承担相应的行政责任和民事责任以弥补饲养人的经济损失和精神损害的同时修复疫情防控下紧张压抑的社会气氛,从而既有利于疫情防控的顺利进行又保障国民的合法权益,促进天理、国法、人情高度契合的疫情防控布局形成。Since the outbreak of COVID-19, a series of problems arose, one of which is the handling of the pets of close contacts or infected persons. It is illegal that the health workers randomly kill pets without the approval of relevant epidemic prevention departments at higher levels. Even if the relevant departments formulate corresponding normative documents, they cannot prevent the suspected violation of the law. The status of pets in the legal relationship can only exist as the objects, but the objects is different from the general object and receives special protection. Although killing the pet at this stage cannot be used in the criminal law norms to impose sanctions, this illegal behavior is still bear the corresponding administrative responsibility and civil responsibility to make up for the economic loss and mental damage of the breeders, restore the tense and depressed social atmosphere under epidemic prevention and control. It will not only help the smooth progress of epidemic prevention and control, but also protect the legitimate rights and interests of the people, and promote the formation of a highly compatible epidemic prevention and control layout with nature, national law and human relations.
