四荒地经营权再流转解释论——以《农村土地承包法》第五十三条为中心

摘　　要：科学认定四荒地经营权法律属性与“再流转”的规范含义是解释四荒地经营权再流转规则的基础。基于历史解释、物债界分的认定标准和承包地“三权分置”改革目标的考量,四荒地经营权承继于原四荒地土地承包经营权,应定性为用益物权。“再流转”的规范含义应指土地经营权设立后的处分行为,由此可认定《农村土地承包法》第五十三条构成四荒地经营权再流转规则。《农村土地承包法》第五十三条并非效力性强制性规定,四荒地经营权再流转的公示同其设立一样,采取登记对抗主义,而与《民法典》第二百三十二条“非基于法律行为的物权变动”的登记属性不同。由此,未经登记不影响四荒地经营权再流转效力,但不得对抗第三人。It’s scientifically identified that the legal attributes of the management right of the four wastelands and the normative meaning of "recirculation" are the bases for explaining the rules of recirculation of the management right of the four wastelands. Based on the historical explanation, the identification standard of the division of property and debt, and the consideration of the reform goal of "Three Rights Separation" of contracted land, the management right of four wastelands which inherited from the original contracted management right of four wastelands should be characterized as a usufructuary right. The normative meaning of "recirculation" should refer to the disposal behavior after the establishment of the land management right. From this, it can be concluded that Article 53 of the rural land contract law constitutes the recirculation rule of the land management right. Article 53 of the rural land contract law is not a valid mandatory provision. The publicity of the recirculation of the four wastelands management rights, like its establishment, adopts the registration antagonism, which is different from the registration of Article 232 of the Civil Code, "changes in real rights not based on legal acts". Therefore, unregistered land does not affect the validity of the recirculation of the management right of the four wastelands, but it cannot be used against a third party.
