电网企业代理购电之“代理”辨考——基于国家发展改革委两份通知的法理分析

摘　　要：为加快推进电价市场化改革,完善主要由市场决定电价的机制,国家发展改革委印发《关于进一步深化燃煤发电上网电价市场化改革的通知》和《关于组织开展电网企业代理购电工作有关事项的通知》,推出了电网企业代理购电这一举措。电网企业代理购电虽然包含有“代理”一词,但并非民事法律规范上的民事代理,而是在用户销售电价形成机制上的政府定价行为。厘清电网企业代理购电的行为性质,有利于避免实际工作中的偏差。To accelerate the market-oriented reform of electricity price and improve the mechanism of setting electricity price mainly by the market,National Development and Reform Commission issued two notices:one is“Notice on further deepening the market-oriented reform of electricity pricing for coal-fired power generation”;the other is“Notice on organizing and carrying out the purchase of electricity with power grid enterprises acting as purchasing agents”,introducing the measure of the purchase of electricity with power grid enterprises acting as purchasing agents.Although the purchase of electricity with power grid enterprises acting as purchasing agents contains the term“agent”,the agency by power grid enterprises is not a“civil agency”in the civil law norms but rather a government price setting act in the mechanism for the electricity sales price to the users.Clarifying the behavior nature of the purchase of electricity with power grid enterprises acting as purchasing agents can avoid the deviation in the actual work.
