摘　　要：数字技术发展使得传播权的扩张动摇以复制权为根基的传统版权理论,网络服务提供者版权过滤义务对“避风港原则”产生变革、技术措施对合理使用制度产生冲击等。在当前中国—东盟经贸合作中,各国版权立法对数字版权中传播权及相关核心制度的回应程度不同,中国数字作品走向东盟国家面临缺乏法律有效保护、缺乏版权登记与交易协作机制、缺乏纠纷解决机制等问题。RCEP契合了中国—东盟数字版权保护的内在需求,中国应贯彻总体国家安全观,完善涉外数字版权保护立法,以传播权为核心,体系化重构数字版权保护制度,建成中国特色的数字版权保护示范体系,推动东盟各国数字版权保护制度调适,并建立中国—东盟数字版权保护法律协调机制。The development of digital technology has shaken the traditional copyright theory based on the "right of reproduction" due to the expansion of the "right of communication", reformed the "safe harbor principle" of the copyright filtering obligation of Internet service providers, and had the impact of technical measures on the "fair use" system. In the current China-ASEAN economic and trade cooperation, the copyright legislation of various countries has different responses to the "right of communication" in digital copyright and related core systems. The move of Chinese digital works to ASEAN countries is faced with problems such as a lack of effective legal protection, of copyright registration and trade cooperation mechanisms, and of dispute settlement mechanisms. RCEP meets the inherent needs of ChinaASEAN digital copyright protection. China should implement the concept of overall national security, improve foreignrelated digital copyright protection legislation, reconstruct the digital copyright protection system with the "right of communication" as the core, build a digital copyright protection demonstration system with Chinese characteristics,promote the adjustment of digital copyright protection systems in ASEAN countries, and establish a legal coordination mechanism for China-ASEAN digital copyright protection.
