未成年人犯罪现状分析及讯问方法研究——以H省为例

摘　　要：未成年人违法犯罪问题与吸毒贩毒、环境污染并列为世界三大社会公害。对H省近几年未成年人犯罪现状进行分析,了解到当下未成年犯罪呈现出手段暴力化、方式多样化、作案团伙化、再犯率高的特点,且未成年人在心理方面表现出认知能力较低、情绪调控能力较差、容易受暗示、意志力具有两极性等特征,因此在对未成年犯罪嫌疑人进行审讯的过程中,应注意教育感化,巩固说服成果,注重对未成年犯罪嫌疑人的特殊保护,选择合适的女性侦查人员参与讯问,调整审讯时间、讯问地点,规范讯问策略的使用,完善合适成年人参与制度等,改进未成年犯罪嫌疑人的审讯流程。Juvenile delinquency is one of the world’s three major social hazards, along with drug and drug trafficking and environmental pollution. According to the analysis of the current situation of juvenile delinquency in H province, juvenile delinquency demonstrates certain characteristics, including use of violence, diversification of crime approaches, gang crime and high recidivism rate. Psychologically, juveniles show low cognitive capacity,poor emotional control, tendency to be hinted and polarization of determination. Therefore, it is necessary to conduct educational influence and to consolidate the gains of persuasion and to provide special protection to criminal suspect in the process of interrogation. At the same time, it is also imperative to choose female investigators in interrogation,adjust interrogation time and place, regulate the strategies of interrogation and improve the system that is suitable for juveniles in order to advance the interrogation procedure of juvenile suspects.
