摘　　要：长期以来公安机关逐利性刑事执法的现象持续存在,突出表现为以下四种:为非法利益而违规立案、长期挂案、恣意抢案、超期扣押等。以利益相关者理论为视角,对执法活动全过程与“利”有关的个体与群体进行归纳,从五方利益主体归纳出逐利性刑事执法的成因有以“利”为导向的执法观念、利益输送者的主动与被动、监督机制失灵等。针对以上问题,通过提出坚持审判中心论和侦查程序本位论理念、深化立法改革以减少逐利性刑事执法制度空间、开展检察机关与监察机关专项监督活动等措施,将平等、公正、法治的社会主义核心价值观融入到公安执法规范体系、公安执法运行体系之中,以期对该不合理执法现象进行系统性治理。For a long time, the phenomenon of profit-seeking criminal law enforcement by public security organs continues to exist, which is manifested in the following four types: illegal registration for illegal interests,long-term suspension of cases, case scrambling and prolonged detention. From the perspective of stakeholder theory, this paper summarizes the individuals and groups related to "interest" in the whole process of law enforcement activities, and concludes the causes of profit-driven criminal law enforcement from the five interest subjects, including the "interest" oriented law enforcement concept, the initiative and passivity of interest transporters, and the failure of supervision mechanism. In view of the above problems, the following suggestions are put forward: adhere to the concept of trial centrality and investigation procedure-based, deepen legislative reform to reduce the space of profit-seeking criminal law enforcement system, carry out special supervision activities of prosecuting authorities and supervision organs, and integrate the core socialist values of equality, fairness and rule of law into the public security law enforcement normative system and public security law enforcement operation system, with a view to systematically controlling this unreasonable law enforcement phenomenon.
