百年经期劳动保护的发展逻辑与中国特色

摘　　要：自20世纪20年代发轫以来,中国的经期劳动保护已有百年发展历程。以二十大提出的“两个结合”观之,百年经期劳动保护的发展逻辑可概括为:基于中西医新旧月经传统及其塑造的女性身体观,随着中国具体实际的百年变化,经期休假、经期卫生和经期禁忌劳动等经期劳动保护措施陆续形成,经期劳动保护由此成为马克思主义妇女解放路线在中国进行本土实践的一项具体发展。经期劳动保护的中国特色由此形成:世界罕有的以综合性经期劳动保护措施促进女性参与物质和人口双重生产的基本制度。助推劳动力性别等级和职业性别隔离的潜在功能也随之显现。已有百年历史的经期劳动保护是社会主义优良传统,需要在中国特色社会主义新时代朝着促进男女平等分享就业权与生育权的方向不断前进。China’s menstrual labor protection has gone through almost 100 years since its burgeoning in 1920s. Its logic can be summarized by the "two integrating" formulated by the CPC’s report to the 20th National Congress.Guided by Marxist theory on women’s liberation and based on the menstruation theory of Chinese and western medicine, the comprehensive measures of menstrual labor protection have been gradually crystallized corresponding to the various historical context. Chinese characteristic of menstrual labor protection is therefore shaped, i.e., with its comprehensive detailed measures which top the world, it has become the basic institution to support women fulfilling their double roles of material production and human reproduction. Its latent function of strengthening gender labor stratification and occupational segregation is also appearing. As the socialist tradition, menstrual labor protection should be improved to promote women sharing the equal right of employment and reproduction with men during the new era of China.
