论综合行政执法主体的制度依据与保障——基于功能主义的分析框架

摘　　要：“控权”为核心的单一规范主义思路作为综合行政执法主体的制度建构依据存在封闭性。面对现代社会日趋复杂的行政执法需要,综合行政执法主体制度的落实过程在坚守规范主义合法性底线的同时,也应当为行政职能的履行提供从法律理论到相关保障机制的功能主义支持。综合行政执法主体的制度逻辑建构以组织结构优化与权力配置增强两项功能标准为内核,但以规范主义标准为界限,这种界限体现在以“概括性授权”条款为依据,受制于比例原则与本质保护原则的约束。基于组织结构优化功能,应当注重赋予地方立法行政机构组织规定权以回应灵活性实际需要;基于权力配置增强功能,应当赋予地方政府配置综合行政执法权以契合整体政府的思维与协调部门之间的权力科学分配。The single normative thinking based on“power control”as the core of the system construction of comprehensive administrative law enforcement is closed.In the face of the increasingly complex administrative law enforcement needs of modern society,the implementation process of the comprehensive administrative law enforcement subject system,while adhering to the normative legitimacy bottom line,should provide functionalist support from legal theory to relevant guarantee mechanisms for the performance of administrative functions.The institutional logic construction of the subject of comprehensive administrative law enforcement takes the two functional standards of organizational structural optimization and power allocation enhancement as the core,but is based on the“general authorization”clause.And it is bound by the principle of proportionality and the principle of protection of essential rights.Based on the optimization function of the organizational structure,attention should be paid to giving the local legislative and administrative organs the power to organize regulations to respond to the actual needs of flexibility;based on the enhanced function of power allocation.The local government should be given the power to allocate comprehensive administrative law enforcement to fit the thinking of the whole government and coordinate the scientific distribution of power between departments.
