论教育行政执法的“综合转向”

摘　　要：将教育行政执法整合划入综合行政执法是教育行政执法体制改革的重要内容。当前的教育综合行政执法改革实践呈现出以民办学校和校外培训机构为重点执法对象、集中行使行政处罚权为主要内容,以及下移执法重心至镇街为重要措施等基本特征。针对执法主体转变制度依据不足、教育综合行政执法的专业性体现不够、教育行政部门与综合执法部门衔接不畅等问题,尤其针对处理“双减”政策下教育行政部门校外教育培训监管执法与教育综合行政执法改革趋势之间的关系,应完善执法制度供给、加强执法队伍建设,创新执法协作机制。The integration of educational administration-related law enforcement into the comprehensive enforcement of educational administration-related law is significant in the reform of the system for educational administration-related law enforcement. Currently, the practice of the reform of the comprehensive enforcement of educational administration-related law features the following:exercising the power of administrative punishment over private schools and out-of-school training institutions,and taking important measures such as delegating the key part of law enforcement to streets and towns. Considering the lack of the basis of the law enforcer conversion system,the unprofessional comprehensive enforcement of educational administration-related law,the poor cooperation between the department of educational administration and the department of comprehensive law enforcement,especially the relationship between the supervision and law enforcement imposed by the department of educational administration on out-of-school training institutions and the trend of the reform of the comprehensive enforcement of educational administration-related law under the policy for "reducing the burdens heaped on students by both schools and out-of-school training institutions," we need to improve the supply of law enforcement systems,promote the development of law enforcers,and make progress in innovations in the mechanism for law enforcement coordination.
