摘 要:建设国内国际相互促进的双循环发展格局,在国际贸易保护主义抬头的背景下,加入RCEP等区域自贸协定是一条必由之路。基于国家制度创业视角,在对电子商务改革的内外环境进行分析后发现,来自全球电子商务市场的机会与挑战及我国电子商务产业自身优势和发展需要,是催生国家对标区域自贸协定条款、进行电子商务改革的主要动机,并促使国家通过对标国际通行标准、冻结搁置、点面联盟、共同发展等四种外部合法性建构战略及在理论建构中融入国际经验、全民参与、改革试点等三种内部合法性建构战略,稳健地实现了与国际规则的对标,在此基础上最终构建了一个国家制度创业战略的整合模型。It is necessary for China to join RCEP and other regional free trade agreements in order to meet the backdrop of international trade protectionism and to construct a dual circulation economic system. This paper aims to build an integrated model of national institutional entrepreneurship strategy for the reform of e-commerce regulations. By introducing PEST analysis and Porter′s diamond model, it is found that it is the opportunity and challenge from the global e-commerce market as well as the advantage and development of the domestic e-commerce industry that motivate China to reform its e-commerce regulations to be in standard with major regional free trade agreements. Two kinds of benchmarking strategies help China reform successfully. First, build external legitimacy by revising domestic e-commerce regulations according to the international standard, freezing and holding unreasonable terms, integrating small terms with large regulations or agreements, and keeping the domestic regulation-making in pace with the regional one. Second, build internal legitimacy by applying international experience into our own theoretical building, encouraging all-round participation and carrying out pilot reforms. These findings not only fill in the gaps in national institutional entrepreneurship but also offer a new view of understanding China′s reform in e-commerce.
