摘　　要：现代犯罪治理要求刑事治理体制机制进行转型,以实现犯罪治理的制度化、规范化、程序化,在治理形式上表现为加强对犯罪的源头治理、系统治理与综合治理。犯罪治理现代化决定了网络犯罪的刑法规制需要坚持系统观念,实现罪刑体系化。我国网络犯罪之罪刑体系处于形成和发展阶段,其罪刑之构建以传统罪刑为导向,具有混融性特征。我国网络犯罪的罪刑构建侧重结果正义,导致网络犯罪的刑罚种类相对单一,罪责也缺乏有效的应变性,且对智能网络犯罪之罪刑缺乏规制,这在很大程度上削弱了网络犯罪刑法规制的体系性。网络犯罪的罪刑体系化要求对网络犯罪加以体系化与类型化,完善网络犯罪刑罚体系,使网络犯罪的罪刑实现均衡化,并对智能网络犯罪予以刑法规制。Modern crime governance requires the transformation of criminal governance institutional mechanism to realize the institutionalization, standardization and proceduralization of crime governance, which is manifested in the form of strengthening the source governance, systematic governance and comprehensive governance of crime.The modernization of crime governance determines that the criminal law system of cybercrime needs to adhere to the system concept and realize the systemization of crime and punishment.The criminal and penal system of cybercrime in China is in the formation and development stage, and the construction of its criminal and penal system is oriented to traditional criminal and penal system, with mixed characteristics.The construction of China’s cyber crime focuses on the result of justice, which leads to a relatively single type of cyber crime penalties, and the lack of effective strain of culpability, and the lack of regulation of intelligent cyber crime, which to a large extent weakened the systemic nature of the cyber crime penal system.The systematization of cybercrime requires the systematization and typification of cybercrime, the improvement of cybercrime penal system, the equalization of cybercrime crimes and penalties, and the regulation of intelligent cybercrime.
