风险治理视域下的公共卫生危机预警法治研究

摘　　要：在公共卫生领域,预警制度承载着危机预防与控制职能,是风险治理体系的重要环节。危机预警的作用机理包括预防式治理、集中式治理、数目化治理、多手段治理,能够有效抑制公共卫生危机的传播与蔓延。基于法治理念、法治结构、法治技术的三元分析框架,能够为危机预警的法治完善提供助益。在法治理念层面,应当确立风险预防理念的指导地位,提高预警程序效率并且实现全周期覆盖;在法治结构层面,需要强化政府主导功能,构建多元信息渠道以及信息互动、反馈机制;在法治技术层面,在信息平台建设、决策标准构建、预防观念塑造等多个方面投入制度资源,实现预警技术的规范化与可操作性。In the field of public health,the crisis warning system bears the function of crisis prevention and control,and is an important part of the risk management system.The action mechanisms of crisis warning include preventive governance,centralized governance,numerical governance and multi-means governance,which can effectively curb the spread of public health crises.The ternary analytic framework based on the concept of the rule of law,the structure of the rule of law and the technology of the rule of law can help to improve the rule of law in crisis warning.At the level of the concept of the rule of law,it is necessary to confirm the guiding role of the concept of risk prevention,improve the efficiency of crisis warning procedures and achieve the full-cycle coverage;at the level of the structure of the rule of law,it is necessary to strengthen the government's leading function,build multiple information channels and information interaction as well as feedback mechanisms;at the technical level of the rule of law,it is necessary to invest institutional resources in the construction of information platforms,decision-making standards,prevention concepts and other aspects to achieve the standardization and operability of crisis warning technology.
