有扶养关系的继子女代位继承权法律适用的再探讨——由湖北高院的民事裁定案引发的思考

摘　　要：有扶养关系的继子女的代位继承权,不是基于继子女的固有权,也非完全基于被代位继承人的继承权,而是中国特色的法律制度,应为法律所明确赋予。而继父母与继子女之间形成扶养关系的事实认定标准在客观标准难以标准化规定前,宜尊重当事人意愿,以意思表示形式化为要件,促进夫妻和谐和保障未成年继子女的健康成长。The subrogation inheritance right of stepchildren with supporting relationship is not based on the inherent right of stepchildren,nor is it completely based on the inheritance right of the subrogated heir,but the legal system with Chinese characteristics,which should be clearly endowed by law. However,before the standardization of the objective standards for determining the facts of the formation of a supporting relationship between step-parents and step-children,it is advisable to respect the will of the parties and formalize the expression of will as an important element to promote the harmony of husband and wife and ensure the healthy growth of minor stepchildren. between husband and wife and ensure the healthy growth of the minor stepchildren.
