预防刑视角下未成年罪犯减刑模式研究  

A Research on the Commutation Mode of Minor Offenders from the Perspective of Preventive Punishment

摘　　要：以H省未成年犯管教所关押的未成年罪犯为研究样本,对减刑幅度进行相关性分析,发现减刑幅度与首次减刑间隔、原判刑期和表扬奖励次数呈正相关,与未成年罪犯终审时的年龄和减刑次数呈负相关。基于预防刑的视角,并借鉴国外经验,从未成年罪犯权益最大化、合理考量原判刑期和减少对监管考核结果依赖等方面提出符合预防刑目的应然减刑模式。Taking the minor offenders imprisoned in the juvenile correctional center of H Province as the research subjects,the paper makes a correlation analysis of the commutation range,finding that the commutation range is positively correlated with the first commutation interval,the original sentence and the times of praise and reward,and negatively correlated with the age at the time of final trial and the times of commutation.From the perspective of preventive punishment,referring to the foreign experience,the paper suggests a commutation mode which meets the purpose of preventive punishment in terms of maximizing the rights and interests of minor offenders,reasonably considering the original sentence,and reducing the decisive effect of the result of supervision.
