摘　　要：电力市场作为实现“双碳”目标的重要领域,合理的电力市场发展模式对我国实现“双碳”目标有着至关重要的作用,电力市场的竞争性转型则是当下促进能源领域低碳发展的理性路径。电力市场表现出可再生能源并网过程中缺少竞争秩序、电力消费环节竞争不充分、电力输配环节不适应竞争环节等问题。这些现象可归结于电力市场的竞争与自然垄断并存的特殊属性,并且部分企业形成的行政垄断与市场势力打破了公平的市场秩序。因此,需要运用法律手段来保障电力市场的竞争性转型。重塑《电力法》的价值目标来明确电力市场的发展方向,在可竞争环节中注重产权激励以及行政垄断,在自然垄断环节中引入激励型监管制度。The electricity market is an important field to achieve the goal of“dual carbon”.A reasonable develop-ment mode of the power market plays a vital role in China's realization of the“dual carbon”goal.The competi-tive transformation of the power market is the rational path to promote the low carbon development of the energy field.The electricity market has the problems including the lack of competition order in the process of grid connec-tion of renewable energy,insufficient competition in electricity consumption,the unadaptablity of power transmis-sion and distribution to the competition.These problems can be attributed to the special feature of the coexistence of competition and natural monopoly in the electricity market,and the fair market order is disturbed by administra-tive monopoly and market power formed by some enterprises.Therefore,we should use legal means to ensure the competitive transformation of electricity market.The value objective of Electricity Law should be redefined to regulate the development direction of the electricity market,the property incentive and administrative monopoly should be emphasized in the competition,and the incentive supervision system should be introduced to the natural monopoly.
