民法典绿色原则的性质探析

摘　　要：本文聚焦于绿色原则区别于其他民法基本原则的独特性,提炼出绿色原则的四大基本性质,即相对独立性、外生限制性、宣示指导性和附属转介性,并系统分析了这些性质何以存在的理论依据与如何实现的实践模式以及它们之间既独立存在又互为补充的辩证统一关系;进一步提出在司法实践中应严格把握绿色原则的适用条件和范围,在特殊场域适度应用的同时,要特别谨慎于绿色原则的单独适用,以便增强其法律适用的实际效果,充分发挥其现实价值,促进经济社会与生态环境的可持续发展。This article focuses on the distinctiveness of the Green Principle from other basic principles of civil law,and summarizes four properties of the Green Principle,which are relative independence,exogenous restriction,declarative guidance,and subsidiary referral.This article also systematically analyzes the theoretical foundation and practical modes of these properties,as well as the dialectical and unified relationship among them,which shows that they exist independently and are complementary to each other.Furthermore,this article holds that the application condition and scope of the Green Principle should be strictly controlled in judicial practice.While the Green Principle can be moderately applied in special areas,extreme caution should be taken if it is applied separately.Only in this way can the practical effect of the Green Principle be enhanced,its realistic value be fully utilized,and the sustainable development of economy,society and ecological environment be promoted.
