摘 要:屡次发生的航空公司拒载旅客事件,对承运人拒载权的合法性以及行使正当性产生了质疑和批评,也凸显了拒载权所存在的滥用风险。综观我国现行法律规范体系,并未对承运人拒载权作出直接的概念界定和判定标准,航空公司在进行拒载的时候往往参照公司自己所制定的相关“运输总条件”,如此将势必影响到旅客的乘机自由和合法权益。避免承运人行使拒载权必须满足一定的条件和标准,在满足实体标准和程序标准双重标准的情形下承运人方可遣离旅客。拒载后旅客权益保护和救济机制的构建也对拒载权滥用的规制意义重大。Repeated incidents of airlines refusing to carry passengers have questioned and criticized the legitimacy and exercise of the carrier's right to refuse to carry passengers,and also highlighted the risk of abusing the right to refuse to carry passengers.With an overview of the current legal systems in China,there is no definite concept and judgment standard for the carrier's right to refuse to carry passengers.Airlines often refer to the relevant"general conditions of transportation"formulated by themselves when refusing to carry passengers,which will inevitably affect passengers'flight freedom and their legitimate rights and interests.To avoid the carrier exercising the right of refusing to carry passengers,certain conditions and standards must be met,and the carrier can send passengers away only if it meets the double standards of substantive standards and procedural standards.It is also of great significance to construct the protection and relief mechanism for passengers'rights and interests and regulate the abuse of refusing to carry passengers.
