现代治理体系构建中的地方治理定位与地方立法权限

摘　　要：基本实现国家治理体系和治理能力现代化是二十大提出的目标,建立现代治理体系推进治理能力现代化意味着要发挥不同治理主体的积极性。地方作为现代治理体系中的治理主体,其与中央共同担负着不同层次的治理任务,并且,地方因为拥有对地方事务的信息优势,中央无法替代地方从事具体的地方事务治理。现有的中央决策地方执行的体制存在治理成效不足、法治化程度不高等问题,主要症结是中央与地方治理权限划分不清,地方积极性没有有效调动。在全面依法治国的大背景下,需要从立法问题入手,解决不能提供满足地方治理需要的法律供给问题。地方治理的实际客观上要求明确地方事务范围,由此定位地方立法权限。合理配置中央与地方的立法,既要发挥地方的积极性,又要注意保持法制统一、中央的统一领导,妥善处理可能出现的法律冲突。具体可以通过协商、备案审查,特别是完善司法审查保证法制统一。Modernizing national governance and governance capacity is the goal set forth by the 20th National Congress of the CPC.Establishing a modern governance system to promote the modernization of governance capacity means giving full play to the enthusiasm of different governance subjects.as the governance body in the modern governance system,the local government share different levels of governance tasks with the central government.Moreover,because of the information advantage of local affairs,the central government cannot replace the local government in the governance of specific local affairs.The existing system of central decision-making and local implementation suffers from insufficient governance effectiveness and low degree of rule of law,the main crux of which is the unclear division of governance authority between the central and local levels and the lack of effective mobilization of local enthusiasm.In the context of a comprehensive rule of law,it is necessary to start from the legislative issue to solve the problem of failure to provide the legal supply to meet the needs of local governance.The reality of local governance objectively requires clarifying the scope of local affairs and thus positioning the local legislative authority.Rational allocation of central and local legislation is necessary to give full play to local initiative while paying attention to maintaining the unity of the legal system and the unified leadership of the central government,and to properly handle possible legal conflicts.Specifically,the unity of the legal system can be ensured through consultation,filing and review,and especially by improving judicial review.
