摘　　要：本文围绕习近平总书记《谱写新时代中国宪法实践新篇章——纪念现行宪法公布施行40周年》一文首次提出的“宪法自觉”与“宪法发展”,全面和系统地描绘了过去40年“宪法自觉”形成和增长的演变过程,分析了宪法理论和宪法制度发展对于“宪法自觉”所产生的积极影响,对于“宪法自觉”在理论、政策、制度和实践层面所表现出来的特征进行了概括和总结,得出了加强党对宪法工作的领导、提升全民宪法素养、建立和完善国家宪法日制度和宪法宣誓制度是增强宪法自觉、促进宪法发展的内在的制度和精神动力的学术结论。在此基础上,本文认为,在加强宪法解释方面,“宪法自觉”仍然存在需要提升的空间,只有在宪法实施方面产生了宪法行动的“自觉”,宪法制度才能真正地得到发展,宪法的根本法权威才能得到有效发挥。This paper forces on the conception of“constitutional self-consciousness”and"constitutional development"referred in the essay on Interpretation of the Core Meaning of the Paper on Commemorating the 40th Anniversary of the Promulgation and Implementation of the Current Constitution written by Secretary General Xi Jinping,comprehensively and systematically describing the growing history of"constitutional self-consciousness"in the past 40 years,and deeply analyzing the positive impact of constitutional theory and system on the growing of"constitutional self-consciousness".The characteristics of"constitutional self-consciousness"at the theoretical,policy,institutional and practical levels are scientifically summarized,and the academic conclusion is reached that strengthening the Party's leadership over the constitutional work,improving the constitutional literacy of the whole people,establishing and improving the national constitutional day system and the constitutional oath system are the internal institutional and spiritual impetus to enhance constitutional self-consciousness and promote the development of the Constitution.On this basis,this paper believes that in strengthening the interpretation of the constitution,there is still room for improvement in the"constitutional self-consciousness".Only when the"self-consciousness"of constitutional action is generated in the implementation of the constitution can the constitutional system be truly developed and the fundamental legal authority of the constitution be effectivelyexerted.
