摘 要:《行政处罚法》第48条规定的公开行政处罚决定是对公开原则的贯彻。以行政处罚决定的“作出—执行”过程为观察视角,作为行政处罚的事后公开制度,行政处罚决定公开并非一种行政处罚类型,而是具有精神作用的事实行为。公开行政处罚决定可以监督行政机关和被处罚人,确保行政处罚的实效性。鉴于违法公开行政处罚决定可能产生不利影响,有必要通过目的限制、程序限制和权利保障进行法律控制。针对行政处罚决定信息的内容复合性和公开行为的从属性,适用时应注重差异化处理和过程性控制,以有效保障当事人的合法权益。The disclosure of administrative penalty decisions stipulated in article 48 of the Administrative Punishment Law is the implementation of the principle of disclosure. From the perspective of the process of making-executing of administrative penalty decisions, as an ex post facto disclosure system of administrative punishment, the disclosure of administrative penalty decisions is not a type of administrative punishment, but a factual act with spiritual effect. The disclosure of administrative penalty decisions can realize the supervision for both the administrative organ and the punished person, and ensure the effectiveness of administrative punishment. In view of the possible adverse effects of unlawful disclosure of administrative penalty decisions, legal control through purpose limitations, procedural restrictions and right protections are necessary. Regarding the composite content of administrative penalty decision information and the subordination of the disclosure, the application should focus on the differentiated treatment and process control to effectively protect the legal rights and interests of the parties.
