摘　　要：如何快速有效化解行政争议是提升政府治理能力的重要问题,作为及时有效化解行政争议的方式,行政复议调解应运而生。检视我国复议调解实践,尚存适用范围难以满足解纷的现实吁求、程序运行难以做到规范统一、调解结果难以确保公正和实效等困境。为破解困境,应将复议调解的主导功能定位为实质性化解行政争议,促进复议化解行政争议的主渠道作用;并聚焦该功能的实现,根据调解的合法性、公正性和有效性要求,优化行政复议调解制度,突破适用范围过窄的藩篱,统一规定完备的调解程序规则,增强调解机构的中立和专业,明确调解书的效力,保障调解结果的公正与实效。To resolve the administrative disputes in a quick and effective way is crucial to the improvement of the government governance capacity.As a result,administrative reconsideration mediation emerges as a timely and effective way of resolving them.According to the review of the practice of reconsideration mediation in China,there are still difficulties in the scope of application to meet the practical demands of dispute resolution,in the standardized and unified operation of procedures,and in the fairness and effectiveness of mediation results.In order to solve the dilemma,the leading function of reconsideration mediation should be defined as the substantive resolution of administrative disputes and promote the main channel role of reconsideration to resolve administrative disputes,focusing on the realization of this function,the administrative reconsideration mediation system should be optimized according to the requirements of legality,fairness and effectiveness of mediation,breaking through the barriers of too narrow scope of application,providing unified and complete rules of mediation procedure,enhancing the neutrality and professionalism of mediation institutions,clarifying the effectiveness of mediation documents,and ensuring the fairness and effectiveness of mediation results.
