数字经济时代平台用工“去劳动关系化”的表征、挑战与应对

摘　　要：数字经济作为经济社会发展的新动能,在转型发展和促进就业方面有着重要贡献。随着数字经济的发展,以“平台—参与者”为特征的新就业形态成为社会发展的“应时之需”,但平台用工存在“去劳动关系化”现象,其特征表现为劳动关系隐蔽化、公共事务责任缺失化、零工劳动者权益保障脆弱化及政府公共资源供给成本扩大化,并对传统社保体系、就业发展、传统劳动关系认定标准及集体协商和民主参与制度等提出挑战。在社会主义市场经济条件下,要应对平台用工“去劳动关系化”带来的不利影响,需要加快制定劳动基准法、加强政府对平台企业用工的监管、明确平台企业的用工主体责任、构建零工特色社保体系、发挥工会在维护零工劳动者合法权益中的独特作用,努力构建中国特色和谐劳资关系,让零工劳动者共享数字经济发展成果。As a new driving force of economic and social development,the digital economy has made important contributions to transformation development and employment promotion.With the development of the digital economy,the new employment pattern characterized by“platform participants”has become the“need in time”of social development.However,there is a“de labor relationship”phenomenon in employing platform workers,which is characterized by the concealment of labor relations,the loss of public affairs responsibilities,the fragile protection of the rights and interests of odd workers and the expansion of the cost of government public resource supply.It also poses challenges to the traditional social security system,employment development,identification standards for traditional labor relations,and collective consultation and democratic participation systems.Under the conditions of a socialist market economy,in response to the adverse impact of the“de labor relationship”of platform employment,we need to accelerate the formulation of the labor benchmark law,strengthen the supervision of government over the employment of platform enterprises,clarify the main responsibilities of platform enterprises,build a social security system with odd jobs characteristics,give play to the unique role of trade unions in safeguarding the legitimate rights and interests of odd workers,and strive to build a harmonious labor capital relationship with Chinese characteristics and make odd workers share the achievements of digital economy development.
