摘　　要：对于数字经济发展带来的诸多挑战,需要在经济法理论的不同层面做出具体回应。首先,在本体论和发生论层面,数字经济并未改变经济法学既有的基本理论框架,运用经济法理论仍可解释数字经济发展的基础及其经济法规制问题;其次,在价值论层面,对数字经济进行经济法规制,仍需遵循和兼顾经济法的各类价值,这更有利于保障和促进数字经济的发展;最后,在规范论和运行论层面,针对数字经济所带来的诸多新问题,需要正视相关主体及其权利、责任追究等方面的特殊性,改变不适应数字经济发展的理论和制度,并在经济法的制定和实施中加以落实。上述三个层面体现了数字经济时代经济法理论的“变与不变”,把握上述“因应之道”,不仅有助于揭示数字经济与经济法的紧密关联以及相应的经济规制原理,深化经济法、信息法和数字法治的理论研究,也有助于切实推进制度完善,促进数字经济的有序健康发展。Many challenges brought by the development of digital economy need specific responses from the theory of economic law in different aspects.Firstly,in ontology and genesis,digital economy has not changed the basic theoretical framework of economic law.Economic law theory can still explain the foundation of the development of digital economy and the regulation of economic Law.Secondly,on the axiology level,the regulation of digital economy still needs to follow and balance the various values of economic law,which is more conducive to the development of digital economy.Finally,on the level of normative theory and operational theory,in view of the many new problems brought by digital economy,it is necessary to face up to the particularity of related subjects and their rights and responsibilities,and to change dysfunctional system in the digital economy,and to implement it in the enactment and implementation of economic law.The above three aspects embody the“change and invariability”of the economic law theory in the digital economy era.Mastering the above“ways of coping”will not only help reveal the close connection between digital economy and economic law and the corresponding principles of economic regulations and deepen the theoretical research of economic law,information law and digital rule of law,but also help practically promote the improvement of the system and promote the orderly and healthy development of digital economy.
