药品监管渎职罪的罪过形式重构--以《刑法修正案(十一)》为视角

摘　　要：药品监管渎职罪与食品监管渎职罪的形式类似,存在两种行为模式,致使罪过形式学说纷争。但故意与过失的罪过形式存在位阶关系,适用该位阶关系厘清间接故意与过于自信的过失之间的降格评价澄清罪过争议,依照同类法益确定罪名适用标准,组合行为标准说与结果标准说建构双层罪过论,以定罪要素和量刑要素决定意欲要素,厘清本罪的罪过形式。The crime of dereliction of duty in drug supervision is similar to the crime of dereliction of duty in food supervision, and there are two behavior modes, resulting in the dispute of the theory of the form of crime. However, there is a hierarchical relationship between the crime form of intention and negligence. Apply this hierarchical relationship to clarify the degraded evaluation between indirect intention and the fault of too private faith, clarify the crime dispute, determine the applicable standard of the crime according to the similar legal interests, and construct a two-tier crime theory by combining the theory of behavior standard and the theory of result standard, so as to determine the element of intention with the elements of conviction and sentencing, clarify the form of this crime.
