从法律视野看我国区域伦理委员会的构建

摘　　要：2018年11月26日,基因编辑婴儿事件震惊全世界,引发了轩然大波。基因编辑婴儿试验未通过合法的伦理审查就进入了临床试验阶段,伦理委员会并未起到其应有的审查作用。深圳和美妇儿科医院的伦理委员会未经备案就为贺建奎团队出具审查意见,说明伦理委员会的设置和工作存在一定的漏洞。造成这样漏洞的一个重要原因就在于伦理委员会不具有独立的法律地位,因此赋予伦理委员会独立的法律地位乃当务之急。具有独立法律地位的区域伦理委员会的构建则刚好满足伦理委员会发展的迫切需求,是我国伦理委员会发展的必然趋势。On November 26, 2018, the genetic baby incident shocked the world and caused a stir. Genetic infant trials have entered the clinical trial stage without passing the legal ethical review, and the ethics committee has not played its role in the review. The ethics committee of Shenzhen Hemei Women’s And Children’s Hospital issued a review opinion for He Jiankui’s team without filing, indicating that certain loopholes existed in the establishment and work of the ethics committee. The author believes that the important cause of such loopholes is that ethics committees do not have independent legal status. Therefore, it is urgent to give the ethics committee an independent legal status. The construction of regional ethics committees with independent legal status just meets the urgent needs of the development of ethics committees and is an inevitable trend of the development of ethics review committees in China.
