区域自然保护地役权制度改革的探索——以江山雪岭社会公益型自然保护项目为例

摘　　要：2021年1月,江山雪岭社会公益型自然保护地正式登记成立,总面积为4 259 hm^(2),其中林地面积为4 225hm^(2),耕地面积为34hm^(2)。以江山市廿八都镇人民政府为地役权人,与第三方公益组织深圳市桃花源生态保护基金会签订合同,将此前已与1 210户农户达成协议的4 225 hm^(2)集体林地交予基金会管理。结果表明,该基金会在科学管理、降低管护成本、强化农户合作以及提升保护效力等方面具有优势,该尝试通过物权制度的使用和社会公益组织的参与,有效降低了行政、财政和宣教成本,提高了保护效能。这为我国地方级自然保护地实施“公益治理”模式提供了新的可能,也为我国自然保护地役权制度的探索提供了新的案例。In January 2021,a public welfare organization,Jiangshan Xueling Nature Center,Zhejiang province,was registered and established,with total area of 4 259 ha,among them,collective forest of 4 225 ha,farmland of 34 ha. The People’s Government of Nianbudu Town signed contract with the third public organization,Shenzhen Taohuayuan Ecological Conservation Foundation to manage 4 225 ha collective forest(after agreement of village committee with 1 200 households). The result demonstrated that the management of the Foundation had advantages of professional administration,reducing financial cost,better cooperation with farmers and increasing conservation effect.
