多源流理论视阈下《体育法》修订的政策议程与展望

摘　　要：《体育法》修订是全面推进依法治体的重要标志。文章采用文献资料法和专家访谈法等研究方法,以多源流理论的公共政策分析框架为理论视角,深入解析《体育法》修订纳入国家政策议程的耦合逻辑,回应《体育法》修订的政策形成过程和影响议程设置的关键性因素。研究发现:体育纠纷和反兴奋剂问题等体育发展中的突出问题和现行《体育法》的滞后性等问题使《体育法》修订纳入国家立法规划的政策议程;政策源流中官方政策引导、立法机构的重视、“两会”代表和专家学者的政策建议是推动《体育法》修订政策形成的“政策原汤”;执政党的理念、人民群众的体育诉求、社会关注的压力以及国外体育法的立法镜鉴是《体育法》修订政治流中的关键变量,为推动《体育法》修订提供强大的政治势能。三大源流交互耦合,合力推动《体育法》修订的政策议程设置与政策形成,揭示《体育法》修订的必然性与必要性,使《体育法》修订被社会各界关注,加快体育法修订的政策进程,为全面推进体育事业高质量发展提供法治保障,为推进体育治理体系和治理能力现代化夯实法治根基。The revision of the Sports Law is an important symbol of comprehensively promoting the rule of law in sports. By using the methods of literature review and expert interviews, and taking the public policy analysis framework of the multi source theory as the theoretical perspective, this paper deeply analyzes the coupling logic of incorporating the revision of the Sports Law into the national policy agenda, and responds to the policy formation process of the revision of the Sports Law and the key factors affecting the agenda setting. The research found that the outstanding problems in the development of sports, such as sports disputes and anti doping issues, and the lag of the current Sports Law made the revision of the Sports Law included in the policy agenda of national legislative planning;The official policy guidance, the attention of the legislature, the policy suggestions of the representatives of the "two sessions" and experts and scholars are the "policy soup" to promote the formation of the revised policy of the Sports Law;The concept of the ruling party, the sports demands of the people, the pressure of social concern and the legislative mirror of foreign sports laws are the key variables in the political flow of the revision of the Sports Law, which provides a strong political potential for promoting the revision of the Sports Law. The three sources and streams are mutually coupled to jointly promote the policy agenda setting and policy formation of the revision of the Sports Law, reveal the inevitability and necessity of the revision of the Sports Law,make the revision of the Sports Law concerned by all sectors of society, speed up the policy process of the revision of the Sports Law, provide legal protection for comprehensively promoting the high-quality development of sports, and lay a solid foundation for the modernization of the sports governance system and governance ability.
