英国铁路缺陷产品召回监管报告借鉴建议

摘　　要：2021年,英国动车组车体裂纹引发缺陷车辆召回,英国铁路安全监管办公室(ORR)对召回处置的全过程进行监管并发布了名为“经验教训”的系列监管报告。报告详述了ORR召回处置中运输安全、客运服务监管内容和调查结论。在运输安全监管方面,ORR进行技术审查和运营商及制造商安全管理体系(SMS)审查。技术审查包括确认缺陷产生原因及处置措施、审查全行业缺陷确认过程等;运营商及制造商SMS审查包括审查行业确保运营安全的管理流程等。在客运服务监管方面,ORR审查缺陷产品召回事件对旅客出行的影响。借鉴英国铁路缺陷产品召回监管报告,提出我国铁路缺陷产品召回监管建议。In 2021,ORR supervised the whole process of the recall of defective vehicles caused by cracks of EMU bodies in Britain and issued a series of reviews called“Lessons Learned”.The reviews detail the regulatory contents and investigation conclusions of the impact of ORR on transport safety and passenger travel during the recall disposal.In technical regulation,ORR reviews the causes of cracking and corrective actions;in terms of operator regulation,ORR reviews the operation of the operator’s safety management system(SMS)for crack inspection,crack removal and resumption of vehicle operation;in terms of passenger service regulation,ORR reviews the impact of the incident on passenger travel.ORR’s reviews on the recall of defective railway products may provide ideas for the regulation of the recall of defective products for railways in China.In this paper,the suggestions on the recall and supervision of railway defective products are proposed.
