摘　　要：目前学界对网络虚拟财产法律属性尚存在许多分歧,进而造成有关离婚案件中网络虚拟财产分割的混乱,因此很有必要对网络虚拟财产法律属性的不同学说进行辨析,同时明晰各类网络虚拟财产的法律属性。基于此,本文立足于为司法实务提供问题解决方案的视角,揭示了网络虚拟财产的法律本质,明确了各类网络虚拟财产判决时应采取的价值认定和分割的方法。At present,the academic community has not reached a consensus on the legal attributes of virtual property,which in turn has caused confusion in the verdicts in divorce cases.Therefore,it is necessary to identify the different claims on the legal attributes of virtual property,so as to clarify the legal attributes of each type of virtual property.To this end,this paper aims to provide solutions to judicial practice,elaborates on the legal attributes of virtual property,and clarifies the method of value determination and division to be adopted when dividing various types of virtual property.
