党的二十大报告中民生法治建设的“公平”话语解读

摘　　要：民生法治建设是习近平法治思想中的重要内容之一,党的二十大报告对民生问题也一如既往地重点阐述。社会公平正义是民生法治建设根本的价值目标,又是评价民生法治建设成效的基本标准。在民生法治层面,社会公平正义是面向全体社会成员的共享正义,以实现全社会共同富裕为根本目标,既强调形式上的公平正义,也注重实质上的公平正义。党的二十大报告围绕民生法治涉及的公平叙事主要有教育公平、机会公平与社会保障的公平,既有基础意义上的公平,又有分配意义上的公平和保障意义上的公平。竞争公平是与民生领域关联极大的公平形式,着力于市场主体的公平资格和通过法治营造良好的竞争环境,同时通过国家的有形之手来保证竞争公平法律的贯彻与执行。Advancing the rule of law for people’s wellbeing is an important content of Xi Jinping thought on the rule of law, which is also a focus in the report of the 20th CPC National Congress. Social fairness and justice are fundamental values and the basic criteria by which to assess the effectiveness of the rule of law for people’s wellbeing. Social fairness and justice, in the sense of the rule of law for people’s wellbeing, is the justice shared for all members of the society that takes the achievement of common prosperity of the whole society as its fundamental goal, and emphasizes both formal and substantive justice.Social fairness and justice in the report of the 20th CPC National Congress concerning people’s wellbeing involve fairness in education, equality of opportunity and equality of social security, all of which are equity in the traditional sense and in the sense of distribution and social security. Apart from that, fair competition is also a form of fairness highly relevant to people’s wellbeing, which is devoted to establish an equal qualification for market entities and create an enabling environment for competition through the rule of law,meanwhile ensuring the implementation and enforcement of fair competition laws through the state’s visible hand.
