基层检察机关自行补充侦查的路径--基于新冠肺炎疫情防控背景  

Methodologies Adopted by First-line Procuratorial Departments to Conduct Self-supplementary Investigation——Based on the Background of Covid-19 Prevention and Control

摘　　要：各级检察机关与公安机关探索建立了侦查监督与协作配合工作机制,落实补充侦查中检警工作职责。基层检察机关自行补充侦查应当注意:一是加大非线下自行补充侦查行使比例;二是积极利用区域协作;三是用好提前介入、审查批捕等前置程序,把好案件入口;四是重视社会参与,扩宽自行补充侦查宽度。检察机关要适应新冠疫情防控常态化的新形势,维持自行补充侦查权实施的有效性,保障刑事司法活动的稳定有序。Procuratorial departments at all levels and police departments have exploringly established a working mechanism for investigation supervision and cooperation,and formulated procuratorates'and police's duties in supplementary investigation.While conducting supplementary investigation,first-line procuratorial departments should attach great importance to the following aspects:1.increase the proportion of offline self-supplementary investigation;2.actively use regional cooperation system;3.make good use of the procedures of early intervention,examination and approval of arrest,and strictly examine the cases;4.pay attention to public participation and broaden the scope of selfsupplementary investigation.Procuratorial departments should gear themselves to the new situation of the normalized COVID-19 prevention and control,maintain the effectiveness of power to conduct selfcomplementary investigative,and ensure the stability and order of criminal justice activities.
