盐穴地下空间开发利用产权体系探究

摘　　要：建立健全地下空间开发利用中的自然资源资产产权体系,解决权利交叉、缺位等现实问题,是有效推动地下空间开发利用工作的重要支撑。文章以盐穴地下空间为研究对象,基于法理学分析与案例研究方法,解析盐穴地下空间开发利用过程中的自然资源资产产权体系。研究发现,盐穴等深层地下空间开发利用活动应以地下空间所有权“肯定说”为法理逻辑起点,突出地下空间作为独立物权客体的法律地位。在归纳总结我国盐穴储气库建设运营实践三种模式的基础上,针对当前盐穴地下空间开发利用中存在的产权体系不完整、权利行使无依据、权利类型相冲突等问题,从强化土地、矿产、地下空间等多种资源协同利用的角度,提出协调盐穴地下空间开发利用中产权关系的政策优化建议:①明确盐穴地下空间建设用地使用权独立于采矿权;②厘清采矿权人行使地下空间使用权的条件;③畅通采矿权转让、租赁、废弃核销等机制;④探索盐穴地下空间开发利用改革试点。The establishment and improvement of the property right system of natural resources assets in the development and utilization of underground space,and the solutions to practical problems,such as overlapping and vacancy of rights,are important supports to promote the development and utilization of underground space effectively.Taking salt cavern underground space as the research object,the paper analyzes the property right system of natural resources assets in the process of salt cavern underground space development and utilization based on jurisprudence analysis and case study method.The research found that the development and utilization of deep underground spaces such as salt caverns should take the"affirmation"of the ownership of underground space as the legal logic starting point,and highlight the legal status of underground space as an independent real right object.Based on summarizing the three modes of construction and operation of salt cavern gas storage in China,and aiming at the problems of incomplete property right system,unfounded exercise of rights,and conflicting types of rights in the current development and utilization of salt cavern underground space,from the perspective of strengthening the coordinated utilization of multiple resources such as land,mineral resources,and the underground space,the paper puts forward policy optimization suggestions to coordinate the property rights relationship in the development and utilization of salt cavern underground space:①Make clear that the right to use salt cavern underground space construction land is independent of the mining right;②Clarify the conditions for mining right holders to exercise the right to use the underground space;③Construct unimpeded mechanisms for the transfer of mining rights,leasing,cancellation and verification;④Explore the reform pilot of salt cavern underground space development and utilization.
