国内外法律语言研究现状对比分析(1998—2021)——基于可视化技术和文献计量分析方法

摘　　要：基于中国知网和Web of Science(科学引文索引数据库)核心期刊文献,本文运用可视化分析软件CiteSpace和文献计量分析方法对1998—2021年间国内外法律语言研究成果进行全面统计与内容分析。研究发现:1)国外发文数量稳步上升;近年来国内却呈现低迷状态,应引起警觉;2)从期刊分布看,国外主要以法学期刊为主,语言学和法律语言学专门期刊为辅;国内引起了语言学界、法学界、翻译界和外语界的共同关注;3)国外法律语言研究注重以语言为工具,意在解决法律问题;国内则以语言为本体,重在解决语言问题;4)国外研究方法多样,重实践;国内研究方法单一,轻实证。针对我国法律语言研究后劲不足的现状,本文建议:重视多样化和系统化的研究方法,应基于中国的本土实践和需求探索和发展;走出语言本体研究的局限,拓宽视角;研究深度由表及里,以学术研究推动法律实践。让法律语言成为讲好中国法治故事、建构法治中国形象的利器。Based on the articles included in the core journals of CNKI and Web of Science,this paper presents a comprehensive comparison and contrast of the developments of the studies of law language between home and abroad from 1998 to 2021 based on CiteSpace visualization technology and bibliometric analysis method.The findings are as follows:1)The number of journal articles published abroad has increased steadily.By contrast,the number in China has experienced a downward trend in recent years,which should be brought to attention;2)In terms of the study field of the periodicals,most international articles are included in legal periodicals,supplemented by specialized periodicals of linguistics and legal language.It has attracted the common attention of the linguistic,legal,translation and foreign language study field in China;3)The articles published in international journals mainly focus on solving legal problems through legal language.In China,language is the study object,focusing on solving language problems;4)The research methods abroad are diverse,with much attention to solving practical problems.The domestic research method is single,with less attention to empirical study.In order to change the current study situation in China,we propose the following suggestions.Firstly,diverse and systematical research methods should be applied to explore more study objects based on China’s local practice of law.Secondly,scholars should change the study focus of emphasizing the language itself and explore more possibilities.Thirdly,discuss more practical problems to improve the depth of research and develop legal practice through related study results.The language of the law should be an effective channel to tell the story of China’s rule of law.
