摘　　要：对贿赂犯罪刑法治理体系的科学评估,是评鉴立法与学理正当性的重要机制。中国贿赂犯罪刑法治理体系以“分体式”“行为群”、法益实质损害为中心加以构建,在法理结构与犯罪治理功能上存在着“三重危机”。国家治理现代化进程中的贿赂犯罪刑法体系更新应当实现:在立场选择上坚定积极治理主义导向,转变刑法功能定位,前置刑法介入基点,弱化刑罚强度,增加刑法干预能力;在优化方案上建构“分体+分层式”的治理体系,全面革新“分体式”罪名体系,细化法益保护层次,建构“微罪—轻罪—重罪”的罪名序列,基于刑法评价确当性与精细化的要求,增设利益冲突型、不法馈赠型贿赂罪,以揭示法益损害为中心准确设定构成要件要素。Scientific evaluation of the criminal law governing system of bribery is an important mechanism for evaluating the legitimacy of legislation and academic theory.The criminal law governance system of bribery crime in China is built around“subject split”,“behavior group”and substantial damage to legal interests,which has“triple crisis”in the legal structure and criminal governance function.In the process of modernization of state governance,the criminal law system of bribery crimes should be updated as follows:Firstly,to form firm positive governance orientation in position.Change the aimed function of criminal law,advance the basic point of criminal law intervention,mitigate the intensity of punishment,and increase the capacity of criminal law intervention.Secondly,the governance system of“subject splitting+layering”shall be constructed in the optimization scheme.Comprehensively renovate the“subject split”accusation system,refine the legal interest protection level,construct the accusation sequence of“misdemeanor,minor crime and felony”,add the interest conflict type and illegal gift type bribery crimes based on the requirements of the appropriateness and refinement of the criminal law evaluation,and accurately set the constituent elements to reveal the damage to legal interests.
