《档案法实施办法》修订的思考——基于《档案法实施条例(修订草案)》的文本分析

摘　　要：将《档案法实施条例(修订草案)》与《档案法实施办法》文本进行对比,《条例草案》突出了法律名称的标准化,对外部结构和法律规则进行了有益调整,为适应时代发展、补正差错而修改了条文,具有价值鲜明、内容新颖、文本精细的进步意义。然而,《条例草案》在内容上还存在档案利用制度建构不完善、档案行政监督机制未健全、档案违法处罚规则较滞后和档案权利救济内容欠充分等不足,需要进行针对性地完善。Comparing the text of Regulations on the Implementation of Archives Law(Revised draft)and Measures for the Implementation of Archives Law,it is found that the draft of Regulations highlights the standardization of legal names,makes beneficial adjustments to the external structure and legal rules,and adjusts and revises the provisions in order to adapt to the development of the times and correct errors.It has the progressive significance of distinct value,novel content and fine text.However,in terms of content,the Draft Regulations still have some deficiencies,such as the imperfect construction of the archives utilization system,the imperfect archives administrative supervision mechanism,the lagging punishment rules of archives violations and the insufficient content of archives rights relief,which need to be improved.
