国内跨国婚姻型贩运妇女治理研究  

Governance of Cross Border Marital Women Trafficking in China

摘　　要：跨国婚姻型贩运妇女犯罪给家庭、社会乃至国家国际安全带来严重的危害,主要原因有四个方面:一是高度父权制使得女性受到歧视;二是男女比例严重失衡;三是全球未形成统一打击共识;四是新冠肺炎疫情进一步增加了婚姻型贩运妇女治理的难度。国内作为“外籍新娘”的主要输入国,针对跨国婚姻型妇女贩运问题治理的建议如下:一是充分运用跨国婚姻登记及户籍政策,消除“外籍新娘”潜在的社会问题;二是加强跨国协作,形成打击婚姻型贩运妇女违法犯罪的共识;三是在法律适用上,综合多种因素分析认定拐卖行为;四是加强预防教育,提升妇女自身防护能力。Women trafficking in the form of transnational marriage has brought serious harm to family,society,national and international safety.There are 4 key factors:1)the discrimination against females caused by high patriarchy;2)the serious imbalance of the proportion between men and women 3)the unreached global consensus to control the crime with joint efforts;4)the COVID-19 further increases the difficulty to attack women trafficking in the form of transnational marriage.The advice to the governance of women trafficking in the form of transnational marriage are:1)Fully leverage the transnational marriage registration and the household registration policy to eliminate the potential social problem of"foreign brides".2)Strengthen the international cooperation to reach the global consensus to attack women trafficking in the form of transnational marriage.3)In the application of law,consider multiple factors comprehensively to analyze and identify the crime of trafficking.4)Reinforce the prevention education to improve women′s self-defense capability.
