司法“造法型”权利生成的法治逻辑

摘　　要：司法是权利生成的重要环节,司法权利生成具有复杂的现实形态,“适法型”权利生成并非全部。“造法型”权利生成是以个案渐进的累积方式解决民众权利需求与供给矛盾的重要方式,也是司法权利生成正当性的论争焦点。厘清其法治逻辑,有助于在法治轨道上推挤司法权利救济体系及救济能力现代化。与兼顾法治形式之维与实质之维的“良法善治”的法治理念相吻合的“规范-价值-事实”的多维法律概念观统合了司法“造法型”权利生成正当性的经典理据。适度司法义务论从“禁止拒绝裁判-依法裁判-裁判论证”的司法义务阶梯性上证成了司法“造法型”权利生成,更从“司法不为与司法不能、规范封闭与认知开放、价值引导与程序规制”角度诠释了司法“造法型”权利生成的法治逻辑。The judicature is an important link in the generation of rights.The judicial"law-making"generation of rights has a complex reality,and the judicial"law-applying"generation of rights is not all.The"law-making"rights generation is not only an important way to solve the contradiction between the demand and supply of people′s rights in a gradual and cumulative way,but also the focus of debate on the legitimacy of the judicial generation of rights.Clarifying the logic of the rule of law in Judicial"law-making"rights generation will push the modernization of the judicial rights relief system and relief capability on the track of the rule of law.A"norm-value-fact"concept accords with a"good law and good governance"concept which considers both the form and substance of the rule of law,and unifies the classic rationale for the justification of the judicial"law-making"generation of rights.The moderate judicial obligation theory justifies the judicial"law-making"generation of rights from its step of"refusal to prohibit judgment-judgment by law-argument-judgment argument",and interprets the rule of law logic of judicial"law-making"rights generation.It also interprets the logic of the rule of law in judicial"law-making"rights generation from the perspective of"judicial inaction and judicial inability,normative closure and cognitive openness,value guidance and procedural regulation".
