摘 要:子女护理假涉及多方主体,而各主体之间的权利义务关系尚未厘清,劳动者的依法休假权无法得到保障,企业的合法用工权遭受损害,最终导致子女护理假在推行过程中频频受阻。建构合理的权利义务关系是破解这一实施困境的关键。据此,需要调整子女护理假的主体、时间及模式,建立合理的制度成本分担机制,完善监督管理机制并以劳动纠纷解决机制保障子女护理假制度的落实。子女护理假应纳入《劳动法》规定的法定假期,子女护理假制度应明确于《劳动合同法》,其成本分担机制应与社会保障法相衔接。The effect of parental leave system to promote family pension is not satisfactory.Parental leave involves multiple subjects,but there exist a lot of problems.For example,the relationship between the rights and obligations of each subject has not been clarified,the workers’right to legal leave can not be protected,the legitimate employment rights of enterprises suffer damage.These eventually lead to frequent obstruction in the implementation of parental leave.The key to break this predicament is to build a reasonable relationship between rights and obligations.Therefore,it is necessary to adjust the subject,time and mode of parental leave,establish a reasonable system cost sharing mechanism,improve the supervision and management mechanism and ensure the use of parental leave system with labor dispute settlement mechanism.Patental leave should be included in the statutory leave stipulated in the Labor Law,the system of parental leave should be clearly defined in the Labor Contract Law,and its cost-sharing mechanism should be connected with the social security law.
